Peter Bethune climbed aboard the Japanese whaling ship Shonan Maru II last month, planning to make a citizens arrest of the ships captain and present a damages bill of $3.2 million for the Ady Gil.

Instead, Bethune was detained by the ships' crew, who held him for trespassing.

The Japanese Coast Guard is expected to arrest Bethune on grounds of trespassing, when the ship births in Tokyo today.

The New Zealander could be jailed for up to three years and slapped with a $1207 fine.

The Sea Shepherd Conservation Society is in the process of arranging legal representation for Bethune.
